1. About these terms

CreateITivity ("CreateITivity", "we") operates this website from its head office at 120 Matheson Blvd East, Mississauga, ON L4Z 1X1, Ontario, Canada. By using the site you accept these terms. If you do not agree with them, please stop using the site.

2. Using the website

You may read, share and link to our pages for ordinary, lawful purposes. You agree not to:

  • copy or republish substantial parts of the site as your own content;
  • try to break into, overload or disrupt the site or the systems behind it;
  • submit false information or someone else's details through our forms;
  • use automated tools to collect personal information from the site.

Articles and guides on this site are general information. They are not legal, financial or tax advice for your specific situation.

3. Client engagements

Paid work, whether search marketing, advertising, content, development or another service, is described in a written proposal or service agreement. That document sets out the scope, timeline, deliverables, fees in Canadian dollars and any commitment period. To keep the work on schedule, clients provide accurate information, the account access we need and timely feedback on drafts and approvals.

4. Fees and invoices

Invoices follow the schedule in your agreement and include applicable sales taxes such as HST. Ad spend paid to platforms like Google or Meta is separate from our fees unless the agreement says otherwise. Ongoing services continue until either side ends them using the notice period in the agreement.

5. Ownership of work

Once an invoice is paid in full, the final deliverables made for you, including content, designs and code written for your project, belong to you. CreateITivity keeps ownership of its pre-existing tools, templates, know-how and methods, and grants you a licence to use any of them that are built into your deliverables. Your accounts and data remain yours throughout.

6. Confidentiality

Each side will keep the other's non-public information private, including logins, business plans, customer records and performance figures, and use it only for the engagement. A separate NDA can be signed on request.

7. Results and liability

Search engines, AI assistants and ad platforms are run by third parties and change their systems without notice, so no specific ranking, traffic level or ad placement can be promised. To the extent permitted by law, CreateITivity's total liability for any claim is limited to the fees you paid for the service in question during the period covered by your agreement, and we are not liable for indirect or consequential losses.

8. Ending an engagement

Either side may end an engagement as set out in the agreement. Fees for work already completed, and any ad spend already committed, remain payable.

9. Links to other sites

We sometimes link to third-party websites. We do not control them and are not responsible for their content or privacy practices.

10. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there (jurisdiction: Ontario, Canada). Any dispute will be heard by the courts of Ontario.

11. Changes

We may update these terms from time to time. The date at the top of this page shows when they last changed.
